Liebl Printing Company Terms of Service

We at Liebl Printing Company understand that your printed or digital work that you ask us to produce is an important part of your business and we will do our best to ensure that the work we perform reflects that importance in its quality. In producing work for you we strive to balance quality, speed and price so that you receive a product that is of high quality, arrives within the timeframe that we agree and is at a competitive price. Terms and Conditions By Placing An Order With Liebl Printing Company, you, the customer, agree to the following terms: 1. Quotations/Estimates Prices posted on our website are subject to change without notice. Written estimates are valid for 30 days or otherwise specified in writing. An estimate not accepted within that term may be changed. The customer cannot accept an estimate then delay the design and printing process unreasonably. 2. Payment Terms All orders placed online must be prepaid by credit card or check after proofs have been agreed. For approved customers, orders are invoiced on net 30 days terms for payment by check or cash. Alternatively bills may be paid by credit card within 7 days of delivery. Early payment is of course appreciated. 3. Orders Liebl Printing Company reserves the right to use its sole discretion in refusing to print or design anything it deems improper or known to be illegal. Liebl Printing Company is not liable for any damages resulting from any violation of copyright laws or illegal use of trade names or slogans. The customer guarantees the legal title of all matter submitted to us for printing and/or publication. 4. Cancellations Once the customer has instructed Liebl Printing Company to commence design or typesetting work or to start printing, but then cancels the order, Liebl Printing Company reserves the right to charge for time and costs incurred up to the point of cancellation. 5. Accuracy of Specifications Quotations are based on the accuracy of the specifications provided. Liebl Printing Company can requote a job at the time of submission if the art provided by the customer does not conform to the information on which the original estimate was based. Orders placed with Liebl Printing Company are to the customer’s knowledge correct, and there are no conditions or agreements relating to the order which are not written, emailed or accompanying the order.  6. Liability Our liability shall be limited to the stated selling price to the customer of any defective goods, and shall in no event include special, consequential, incidental, indirect or similar damages, including without limitation, lost profits. Liebl Printing Company warrants that every product created by it meets industry standard for such product and is free of any material defect in workmanship. IT IS EXPRESSLY AGREED THAT THIS WARRANTY IS IN LIEU OF ALL WARRANTIES OF FITNESS FOR PARTICULAR USE AND MERCHANTABILITY. Liebl Printing Company makes no other warranty and no actions or words of Liebl Printing Company or its officers, employees or agents shall constitute a warranty. 7. Indemnification The customer represents that it has the legal right to produce all digital or printed materials ordered from Liebl Printing Company. In the event that a charge, claim or demand, or arbitration, action or proceeding (collectively, a "Claim") is made or commenced against Liebl Printing Company based upon, relating to or arising from the alleged wrongful acts of the customers, or alleging that the design or printing performed or product produced by Liebl Printing Company ordered by the customer: (a.) infringes any copyright, patent or other proprietary right of any person; or (b.) contains matter that is libelous, slanderous, defamatory, scandalous or obscene, then the customer shall indemnify and hold Liebl Printing Company harmless from and against any loss, damages, cost and expense arising from or related to the Claim including without limitation; (1.) defending Liebl Printing Company against any such Claim (2.) paying any judgment or award against the customer; and (3.) reimbursing Liebl Printing Company for any legal fees and expenses it reasonably incurs in responding. 8. Electronic Manuscripts/Images  Liebl Printing Company is not responsible for accidental loss or damage to media supplied by the client or for errors on artwork supplied by the client. Until Liebl Printing Company can evaluate digital files, no claims or promises are made about our ability to work with jobs submitted in digital format, and no liability is assumed for problems that may arise. Any additional translating, editing, or programming needed to utilize client-supplied files will be charged at our current rates. 9. Alterations/Corrections Customer requested alterations must be specified in writing and must include all corrections or changes from the original specifications. Any resulting additional work may be charged at our current rates. Minor alterations, such as a mis-spelt word or anything Liebl printing Company inadvertently omits from the customers original specification would not incur any charges. 10. Prepress Proofs When requested by the customer, Liebl Printing Company will submit color proofs for the customer's review and approval via email. Proofs must be returned to Liebl Printing Company either by mail, email or in person at our offices marked "Okay to Print." or "Revised Proof Required" by the customer. Until  the proof is returned, no additional work will be performed. Liebl Printing Company will not be responsible for undetected errors if: • Proofs are waived by the client; • The work is printed per the client's emailed or written approval; • Requests for changes are communicated verbally. All requests for changes of any kind must be made in writing to avoid misunderstandings and a further proof approved.. 11. Color Proofing of Printing Work Because of differences in equipment, paper, inks, and other conditions between color proofing and production pressroom operations, a "pleasing color" variation between color proofs and the completed job [as determined by generally accepted trade technical methods] is to be expected. When such a variation occurs, it will be considered acceptable performance. 12. Printing Over-runs/Under-runs Liebl Printing Company will normally deliver the exact quantity of goods ordered plus a small additional amount, for which there is no extra charge. In the event of an under-run, Liebl Printing Company will bill for the actual quantity delivered. For more complex jobs such as those involving a series of operations including collating, folding, trimming and drilling, Liebl Printing Company print a higher quantity than ordered to allow for losses during finishing. Liebl Printing Company reserves the right to charge for additional completed items up to the generally accepted trade practice of plus or minus 10%. If this may be a problem, such as due to budget constraints, please advise this when the job is specified and a revised quote will be prepared. 13. Delivery Charges for delivery of materials and supplies to the customer or as the customer directs are not included in quotations unless specified. Liebl Printing Company is not responsible for delays and/or damage incurred during shipping. Title for finished work passes to the customer upon delivery to the carrier at shipping point; or upon collection; or local delivery by Liebl Printing Company staff. In the case of digital design orders, delivery is deemed to have occurred when the file(s) are emailed to the customer or uploaded to the clients website. 14. Claims Claims for defects, damages, or shortages must be made by the client in writing no later than 10 calendar days after delivery. If no such claim is made, Liebl Printing Company and the client will understand that the job has been accepted. By accepting the job, the client acknowledges that Liebl Printing Company's performance has fully satisfied all terms, conditions and specifications. 15. Disputes & Venue For legal purposes, the venue for any dispute shall be Coos County, New Hampshire, USA.  16. Right to Subcontract Liebl Printing Company shall have the right to assign any portion of the work required to another contractor to meet deadlines or price points. 17. Workmanship Guarantee We guarantee all orders to be free of defects in workmanship. If any printing order does not match the generally accepted trade standards, we will reprint the order or issue the customer a refund at our discretion. A discount may be offered if the work is sub-standard but is still useable. If the sub-standard work was required for a particular event deadline then we would of course offer a refund or discount if reprinting would not meet the deadline. Refunds or reprints are contingent on your agreement that we may collect and destroy the work that is defective. 18. Privacy Statement Any information that Liebl Printing Company collects from order processing or from any inquiries is not shared with any other company other than is necessary to complete the order. Your information is only used for production, contact, billing, and shipping purposes. Your credit card information is never stored by Liebl Printing Company. Please see our Online Privacy Policy for full details. 19. Samples Liebl Printing Company may use your product for samples or advertising purposes. 20. Physical Proofs Inkjet and laser prints are known to look substantially different than offset printing or computer screen and indeed vary from one inkjet or laser printer to the next. We offer spot color printing using Pantone Color matching and we offer full color printing by batch printing several different jobs at the same time. Batch printing is used by all full color printers to reduce prices to an acceptable level. It costs over $1,500 to set up one of our presses for a full color print run, so batch printing is the only way to make small print jobs cost effective. 21. Changes to This Policy Liebl Printing Company may change, modify, add or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless otherwise stated.
